Welcome to Paid.Link. By downloading, registering with, and otherwise accessing Paid.Link and the services provided by Paid.Link, You agree to the following Terms of Service (“Terms”). Please review this Agreement and if you agree with all of the terms herein, then please accept the Terms where indicated. Upon your acceptance of these Terms you may then access and use our services.

The following is an agreement between “You” the User of the Services offered by Paid.link and WowLink PTE, Ltd, the owner of the Paid.Link website and application (“WowLink PTE, Ltd” or “Paid.Link”).  Paid.link’s services, however accessed and avaibale to You are referred to herein as “Services” and/or “Application”

1. License to Use the Application

Subject to these Terms, we grant You a non-exclusive, non-transferable, non sublicensable, personal, limited, revocable license to use the Services of Paid.Link. Any other use of Paid.Link is prohibited. We reserve all rights in and to Paid.Link and the services provided by Paid.Link through this Application and we reserve the right to revoke this license at any time.

2. License Restrictions

Except as permitted under these Terms, You agree (1) not to copy, reproduce, republish, reuse, upload, post, transmit, or distribute any content presented in the Application or otherwise provided by Paid.Link, including without limitation for public or commercial purposes; (2) not to make alterations to, or modifications of, the whole or part of the mobile or web application or any content of Paid.Link; (3) not to decompile or reverse engineer or create derivative works of the whole or any part of the mobile or web application; (4) not to remove any copyright, trademark or other proprietary notice from the Application.

3. Improper Use

You agree not to use the Application or the Services of Paid.Link in any unlawful manner, for any unlawful or criminal purpose, or in any manner inconsistent with these Terms.

You agree not to use the Application and/or Services in a way that would damage impair or compromise our technical systems and data or that would interfere with other users use of the Application.

4. Receipt and Use of Consumer Information of Third Party Purchasers

You acknowledge that in using our Services You may collect and receive identifying and other consumer information of third parties. You agree to use any such information solely to process and complete the third party transaction between You and the third party. You agree that any collection, request for, or use of third party consumer information for any other purpose is an Improper Use of our Services and  a violation of these Terms of Use.

5. Access to Your Content

You agree to allow us, or a 3^rd party authorized by us, to access information related to Your account and your use of the Services, from time to time at our discretion, including accessing and viewing content of any and all products, content, links to websites, posted or otherwise proffered by You pursuant to Your use of our Services.  You acknowledge that this ability to access Your accounts in this manner is required to ensure security of the Application as set forth in our Privacy Policy, incorporated herewith, and to ensure compliance with the Terms of Use.

6. Suspension of Accounts

Paid.Link may suspend Your account if We detect any suspicious activity regarding Your Account. We reserve the right to enquire to You about any activity on Your account we deem suspicious and to request further information from You, which information You agree to not reasonably withhold, as part of our investigation into such suspicious activity.  Any account so suspended shall be re-instated only upon a finding by Paid.Link that there has been no breach of the terms of Use and that the Account is otherwise suitable for re-instatement.

7. Minimum Age Requirement

Paid.link offers its Services and Application only to those users aged eighteen years and older. Your acceptance of and agreement to these Terms of Use is an express acknowledgement and affirmation by You that You are aged 18 years or over.

8. Intellectual Property Rights

 You acknowledge that all intellectual property rights in and to the Application are owned by WowLink, PTE, Ltd.. or its licensors and that You have no rights in or to the Application or its content other than the right to use the Application and services therein in accordance with these Terms.

All trademarks, service marks, trade names, and logos are owned by WowLink PTE, Ltd., or are used by permission. Nothing contained in the Application can be construed as granting, by implication or otherwise, any license or right to use any trademark, service mark, trade name or logo displayed within the Application without the written permission of WowLink PTE, Ltd. You acknowledge that you have no right to have access to the Application in source code form.

9. Disclaimers

 We make no warranty as to the completeness or accuracy of any information or content provided by the Application. Subject to the Privacy Rights outlined here, such information is subject to change at any time and without any notice. 

We make no warranty that the functions contained in the Application will be error-free or that services will be available uninterrupted. Nor do we warrant that the Application is free of viruses.

The Application and its services are provided “as is” and WowLink, PTE, Ltd., excludes all warranties of any kind, express or implied including the warranties of merchantability, fitness for a particular purpose, and non-infringement.

You acknowledge that the Application and Services are provided over a mobile network and the quality and availability of network connections may be affected by factors outside our control.  We assume no liability for any damages related to any such network issues.

10. Limited Warranty

Paid.Link shall be validly licensed, of satisfactory quality, and fit for the purpose for which it was provided. It shall comply with the description made available to You prior to downloading it. IN the event of any failure to comply with the above limited warranty, Paid.Link shall provide as Your sole remedy either repair or replace the Application or if that is not possible provide an appropriate refund.

Notwithstanding the above, Paid.Link shall not be responsible for any damage due to a failure to correctly install the Application or to have in place the minimum operating requirements.

11. Limitation of Liability

 To the extent permitted by law, Paid.Link shall not be liable to You for any loss, injury or damages (including any special, punitive, consequential or indirect damages, lost profits, lost revenues, or other incidental damages) arising out of Your use of Paid.Link’s services or Your inability to use such services.

You agree to use Paid.Link and its services provided by the Application at your own risk. You agree that Paid.Link is not responsible or liable for Your illegal, unauthorized use of the Application.

12. Indemnification

 To the extent permitted by Law, You agree to indemnify Paid.Link for any claims, actions, demands, losses, liabilities, damages, costs, and expenses, including legal fees, reasonably incurred by us that arise out of Your use of the Application in breach of these Terms.

13. Termination

Paid.Link may terminate or suspend Your access to the Services provided by it and to the Application at any time, without notice and for any reason in its sole discretion. Paid.Link may also suspend, discontinue or cancel the Application at any time without notice.

14. Fees.

You acknowledge that our fee structure is subject to change and depends on, among other things, the level of activity of use by You of our Services. We reserve the right to increase or decrease the fees charged for Your use of our services based on such level of activity.

 

Currently, the Paid.link fee is 1% of the transaction amount on top of the Payment Processing Company. The Paid.link fee may be reduced for registered users of the Affiliate Program and using affiliate links as described in further detail in the Terms and Conditions for the Affiliate Program.

15. Affiliate program

Registration and Participation in the Paid.Link Affiliate Program is governed by these Terms and Conditions as well as the Terms and Conditions for the Paid.Link Affiliate Program, which are found here.

16. Payment Processor Disputes and Refunds

You agree that any merchant disputes or refunds are to be processed through the third party Payment Processing Company and are subject to the rules of the Payment Processing Company and the terms and conditions You have with such Payment Processing Company. We are not responsible for Merchant disputes or Merchant refunds.

17. Taxes.

You agree to be solely liable for any obligations to collect, pay, and/or report any sales tax or value added tax (VAT) to any applicable authority as a result of any merchant transactions processed through our Services. 

18. Other Terms

In addition to the terms set forth in the Paid.Link Privacy Policy, found here, these Terms constitute the entire agreement between Paid.Link and You with respect to Your use of the Application.

No agency, partnership, joint venture or employment relationship is created as a result of these Terms. Neither You or Paid.Link has the authority under these Terms to bind the other in any respect.

Paid.Link may transfer our rights and obligations under these Terms to another entity without affecting any of Your rights or obligations pursuant to these Terms.

To the extent permitted by applicable law, these Terms are governed and construed by the laws of Singapore and you consent to the non-exclusive jurisdiction of the courts of Singapore. We reserve the right to bring proceedings against You pursuant to or arising from a breach of these Terms in your country of residence.

We periodically update these Terms of Use. You will be notified of any and all material changes and updates to these Terms prior to the change or update taking effect to provide you with an opportunity to review and consider the changes.
